Zuma Hotel Distance Sales Contract

1. Parties

This Distance Sales Contract (“Contract”) is concluded electronically between:

and

Buyer (Guest / Customer):
The person making a reservation through the Zuma Hotel Cyprus website or affiliated booking platforms (“Customer”).

Both parties agree to the following terms and conditions.


2. Subject of the Contract

The subject of this Contract is the provision of accommodation services (room booking, stay, and related hotel services) through electronic means, as well as determining the rights and obligations of both parties in accordance with consumer protection and distance sales regulations.


3. Nature of the Service

The Customer reserves one or more rooms at Zuma Hotel Cyprus via the online reservation system.
This Contract covers the accommodation period, price, and services (room type, breakfast, extras, etc.) selected during booking.

The detailed information regarding the selected service is displayed before final confirmation on the reservation page and forms an integral part of this Contract.


4. Reservation and Payment Terms

  1. All reservations are confirmed only after full or partial payment (as indicated during the booking process).

  2. Payments can be made by credit/debit card, bank transfer, or other available online payment systems.

  3. Upon confirmation, the Customer will receive a reservation confirmation email containing booking details and a reference number.

  4. The Customer is responsible for providing accurate contact and payment information. Zuma Hotel Cyprus is not liable for reservation errors arising from incorrect information entered by the Customer.


5. Cancellation and Refund Policy

  1. The Customer may cancel or modify the reservation according to the cancellation conditions stated at the time of booking.

  2. Flexible Rate: Cancellations made up to [x days] before check-in are free of charge; after this time, one night’s accommodation fee (or the full amount, if specified) will be charged.

  3. Non-Refundable Rate: Cancellations, modifications, or no-shows are subject to 100% charge of the total booking value.

  4. Refunds (if applicable) will be made to the original payment method within [x business days].

  5. The hotel reserves the right to cancel a reservation in case of force majeure (e.g., natural disasters, public health emergencies, overbooking errors). In such cases, the full amount paid will be refunded.


6. Check-in and Check-out Policy

  • Check-in: from [14:00]

  • Check-out: until [12:00]
    Late check-out may incur additional fees depending on room availability.


7. Prices and Taxes

  1. Prices displayed on the website are in [currency] and include applicable taxes unless otherwise indicated.

  2. Zuma Hotel Cyprus reserves the right to change room rates, promotions, and packages at any time.

  3. The total amount payable for the reservation is confirmed before final approval and payment.


8. Responsibilities of the Parties

Hotel’s Responsibilities:

  • To provide the booked accommodation service in accordance with the reservation details.

  • To ensure that facilities and services meet the described standards.

Customer’s Responsibilities:

  • To use hotel facilities with due care and in compliance with hotel rules.

  • To pay for any additional services used during the stay (e.g., minibar, spa, meals).

  • To behave in a manner that does not disturb other guests or damage hotel property.


9. Right of Withdrawal

According to consumer protection legislation, the Customer does not have the right of withdrawal for accommodation, transport, catering, or leisure services that must be provided on a specific date or within a specific period.
However, Zuma Hotel Cyprus voluntarily provides cancellation and refund options stated in Article 5.


10. Personal Data Protection

The Customer’s personal data is processed in accordance with Zuma Hotel Cyprus’s Privacy & Personal Data Protection Policy, available on the website.
By accepting this Contract, the Customer acknowledges having read and agreed to the privacy policy.


11. Communication and Notifications

All notices and communications between the parties shall be made via the email address provided by the Customer during booking or via the contact details of the Hotel.
Electronic communications are deemed legally valid and binding.


12. Force Majeure

In case of unforeseen events such as natural disasters, pandemics, governmental restrictions, or technical failures preventing the fulfillment of obligations, neither party shall be held liable.


13. Governing Law and Jurisdiction

This Contract is governed by the laws of the Turkish Republic of Northern Cyprus (or Republic of Turkey, as applicable).
Any disputes arising from this Contract shall be submitted to the competent courts and enforcement offices of [city, e.g., Kyrenia / Girne].


14. Acceptance

By confirming the online reservation and completing the payment, the Customer acknowledges that they have read, understood, and agreed to all terms and conditions of this Distance Sales Contract.
